By creating an account, accessing the application, or using Pulse Check, you confirm that you have read, understood, and agree to be bound by these terms and the Pulse Check Privacy Policy.

2. Eligibility
You must be legally able to enter into a binding agreement to use Pulse Check. You may not use the service where its use is prohibited by applicable law.

5. No Emergency Response Service
Pulse Check is not a police, fire, ambulance, rescue, emergency dispatch, healthcare, nursing, home monitoring, or medical alert service.
Pulse Check does not guarantee that an emergency contact will receive, read, acknowledge, or act upon an alert.
Contact local emergency services immediately. Do not wait for a Pulse Check reminder, alert, contact response, or acknowledgement.
6. No Medical Advice
Pulse Check does not provide medical advice, diagnosis, treatment, clinical monitoring, or professional healthcare services.
Information displayed within Pulse Check is provided for general organizational and safety check-in purposes only. You should consult a qualified professional for medical, healthcare, caregiving, legal, or safety advice.
7. User Responsibilities
You are responsible for configuring and using Pulse Check in a safe, accurate, and lawful manner.
- Complete check-ins according to the schedule you select.
- Maintain accurate reminder times and timezone settings.
- Keep emergency contact information current.
- Confirm that notification methods are enabled and working.
- Test your account and contact setup periodically.
- Maintain an independent emergency and safety plan.
- Use emergency services directly when urgent assistance is required.
- Avoid relying exclusively on Pulse Check for personal safety.
8. Emergency Contacts
You may provide names, phone numbers, and email addresses for people you select as emergency contacts.
You represent that you have permission to provide their contact information and to allow Pulse Check to send safety notifications to them.
You are responsible for informing contacts about their role and explaining what action they should take if they receive an alert.
9. Notifications and Delivery
Pulse Check may send reminders and alerts through email, text messages, push notifications, or other available communication methods.
Notification delivery can be delayed, blocked, misdirected, or prevented by factors outside Pulse Check's control, including:
- Internet, cellular, carrier, or email provider outages.
- Incorrect or outdated contact information.
- Spam filters, blocked senders, or device settings.
- Battery failure, device failure, or loss of network access.
- Third-party platform outages or service interruptions.
- User settings, quiet hours, or disabled notifications.
Pulse Check does not guarantee successful, immediate, or uninterrupted delivery of any reminder or alert.
10. Text Messages
When text messaging features are enabled, you authorize Pulse Check and its service providers to send service-related text messages to the phone numbers associated with your account or emergency contacts.
Message and data rates may apply. Mobile carrier delivery is not guaranteed. You are responsible for obtaining any required consent before adding another person's phone number.
11. Paid Plans and Subscriptions
Pulse Check may offer free and paid subscription plans. Available features, limits, and pricing may vary by plan.
- Subscription charges are billed according to the selected plan.
- Subscriptions may renew automatically unless cancelled before the next billing date.
- Prices may change with advance notice when required.
- Paid features may become unavailable if payment fails or a subscription ends.

12. Payment Processing
Payments may be processed by Stripe or another third-party payment provider. Your use of payment services may also be subject to the provider's terms and privacy policies.

13. Cancellation

Unless otherwise stated, cancellation stops future renewal charges but does not automatically refund charges already paid. Paid access may continue through the end of the current billing period.
14. Refunds

- Do not use Pulse Check to violate another person’s privacy or legal rights.
16. Suspension and Termination

17. Account Closure
You may request account closure by contacting support. Identity verification may be required before an account is closed or deleted.
Some records may be retained when necessary for billing, fraud prevention, security, dispute resolution, recordkeeping, or legal compliance.

20. Intellectual Property
Pulse Check, its name, application design, software, branding, text, graphics, logos, features, and related materials are owned by Pulse Check or its licensors and are protected by applicable intellectual property laws.
These terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the application for its intended purpose.
21. User Content and Feedback
You retain responsibility for information you enter into Pulse Check.
When you submit suggestions or feedback, you allow Pulse Check to use that feedback to improve the application without creating an obligation to compensate you.
22. Third-Party Services
Pulse Check relies on third-party services for functions such as hosting, authentication, databases, email, text messages, payment processing, and monitoring.

These terms are governed by applicable United States law and, unless otherwise required, the laws of the State of Indiana, without regard to conflict-of-law principles.
