1. Acceptance of Terms

These Terms of Service govern your access to and use of the Pulse Check Professional website, application, features, communications, subscriptions, and related services.

By creating an account, accessing the application, or using Pulse Check, you confirm that you have read, understood, and agree to be bound by these terms and the Pulse Check Privacy Policy.

If you do not agree to these terms, you should not create an account or use the service.

2. Eligibility

You must be legally able to enter into a binding agreement to use Pulse Check. You may not use the service where its use is prohibited by applicable law.

Pulse Check is not directed to children under 13. Accounts used for minors must be created, authorized, and supervised by a parent, legal guardian, or other properly authorized adult when permitted by law.

3. Account Registration

Certain Pulse Check features require a registered account. You agree to provide accurate, current, and complete account information.

• You are responsible for protecting your password and account access.
• You are responsible for activity performed through your account.
• You must promptly update inaccurate or outdated account information.
• You must notify Pulse Check if you suspect unauthorized account access.
• You may not impersonate another person or create an account using false information.

4. Description of the Service

Pulse Check allows users to schedule safety check-ins, record completed check-ins, configure reminders, add emergency contacts, and create alerts when certain check-in conditions are not met.

Features may include email alerts, text message alerts, acknowledgement links, contact priority, alert escalation, check-in history, analytics, reports, family features, wellness features, and subscription services.

Features may change, be improved, be limited, or be removed as the application develops.

5. No Emergency Response Service

Pulse Check is not a police, fire, ambulance, rescue, emergency dispatch, healthcare, nursing, home monitoring, or medical alert service.

Pulse Check does not guarantee that an emergency contact will receive, read, acknowledge, or act upon an alert.

6. No Medical Advice

Pulse Check does not provide medical advice, diagnosis, treatment, clinical monitoring, or professional healthcare services.

Information displayed within Pulse Check is provided for general organizational and safety check-in purposes only. You should consult a qualified professional for medical, healthcare, caregiving, legal, or safety advice.

7. User Responsibilities

You are responsible for configuring and using Pulse Check in a safe, accurate, and lawful manner.

• Complete check-ins according to the schedule you select.
• Maintain accurate reminder times and timezone settings.
• Keep emergency contact information current.
• Confirm that notification methods are enabled and working.
• Test your account and contact setup periodically.
• Maintain an independent emergency and safety plan.
• Use emergency services directly when urgent assistance is required.
• Avoid relying exclusively on Pulse Check for personal safety.

8. Emergency Contacts

You may provide names, phone numbers, and email addresses for people you select as emergency contacts.

You represent that you have permission to provide their contact information and to allow Pulse Check to send safety notifications to them.

You are responsible for informing contacts about their role and explaining what action they should take if they receive an alert.

9. Notifications and Delivery

Pulse Check may send reminders and alerts through email, text messages, push notifications, or other available communication methods.

Notification delivery can be delayed, blocked, misdirected, or prevented by factors outside Pulse Check's control, including:

• Internet, cellular, carrier, or email provider outages.
• Incorrect or outdated contact information.
• Spam filters, blocked senders, or device settings.
• Battery failure, device failure, or loss of network access.
• Third-party platform outages or service interruptions.
• User settings, quiet hours, or disabled notifications.

Pulse Check does not guarantee successful, immediate, or uninterrupted delivery of any reminder or alert.

10. Text Messages

When text messaging features are enabled, you authorize Pulse Check and its service providers to send service-related text messages to the phone numbers associated with your account or emergency contacts.

Message and data rates may apply. Mobile carrier delivery is not guaranteed. You are responsible for obtaining any required consent before adding another person's phone number.

11. Paid Plans and Subscriptions

Pulse Check may offer free and paid subscription plans. Available features, limits, and pricing may vary by plan.

• Subscription charges are billed according to the selected plan.
• Subscriptions may renew automatically unless cancelled before the next billing date.
• Prices may change with advance notice when required.
• Paid features may become unavailable if payment fails or a subscription ends.
• Certain features may require a separate agreement or custom business plan.

12. Payment Processing

Payments may be processed by Stripe or another third-party payment provider. Your use of payment services may also be subject to the provider's terms and privacy policies.

You authorize applicable subscription charges, taxes, and fees to be charged to the payment method you provide.

13. Cancellation

You may cancel a paid subscription through the subscription management page or by contacting billing support.

Unless otherwise stated, cancellation stops future renewal charges but does not automatically refund charges already paid. Paid access may continue through the end of the current billing period.

14. Refunds

Refund requests are reviewed individually and may be subject to applicable law, payment processor rules, subscription terms, and the circumstances of the request.

Contact billing@pulse-check.com with the account email, charge date, charge amount, and a description of the request.

15. Acceptable Use

You agree not to misuse Pulse Check or interfere with the service.

• Do not use Pulse Check for unlawful, fraudulent, abusive, or deceptive activity.
• Do not send threatening, harassing, misleading, or unauthorized notifications.
• Do not access another person’s account without permission.
• Do not attempt to bypass security controls or account restrictions.
• Do not introduce malware, harmful code, automated attacks, or excessive traffic.
• Do not reverse engineer, copy, scrape, resell, or exploit the service except where permitted by law.
• Do not use Pulse Check to violate another person’s privacy or legal rights.

16. Suspension and Termination

Pulse Check may suspend, restrict, or terminate access when reasonably necessary to protect users, service providers, the application, or the public.

Reasons may include violation of these terms, fraudulent activity, nonpayment, abusive conduct, security risks, unlawful use, or actions that disrupt the service.

17. Account Closure

You may request account closure by contacting support. Identity verification may be required before an account is closed or deleted.

Some records may be retained when necessary for billing, fraud prevention, security, dispute resolution, recordkeeping, or legal compliance.

18. Service Availability

Pulse Check aims to provide a reliable service, but uninterrupted availability is not guaranteed.

The service may be temporarily unavailable because of maintenance, updates, security work, internet outages, database issues, third-party platform interruptions, or other circumstances.

19. Changes to the Service

Pulse Check may add, modify, limit, suspend, or discontinue features at any time.

Updates may be made to improve security, reliability, usability, legal compliance, performance, or business operations.

20. Intellectual Property

Pulse Check, its name, application design, software, branding, text, graphics, logos, features, and related materials are owned by Pulse Check or its licensors and are protected by applicable intellectual property laws.

These terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the application for its intended purpose.

21. User Content and Feedback

You retain responsibility for information you enter into Pulse Check.

When you submit suggestions or feedback, you allow Pulse Check to use that feedback to improve the application without creating an obligation to compensate you.

22. Third-Party Services

Pulse Check relies on third-party services for functions such as hosting, authentication, databases, email, text messages, payment processing, and monitoring.

Pulse Check is not responsible for the independent actions, policies, availability, security, or performance of third-party providers.

23. Disclaimer of Warranties

To the maximum extent permitted by law, Pulse Check is provided on an “as is” and “as available” basis.

Pulse Check does not warrant that the service will always be available, error-free, secure, accurate, timely, or suitable for every user or situation.

No statement, feature description, support response, or communication creates a warranty unless expressly stated in a written agreement.

24. Limitation of Liability

To the maximum extent permitted by law, Pulse Check and its owners, employees, contractors, providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes damages related to missed check-ins, delayed or failed notifications, contact inaction, service outages, lost data, lost profits, personal injury, property damage, or reliance on the application.

Some jurisdictions do not allow certain liability limitations. In those jurisdictions, limitations apply only to the maximum extent permitted by law.

25. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pulse Check and its owners, providers, contractors, and affiliates from claims, damages, losses, liabilities, and expenses arising from your misuse of the service, violation of these terms, or violation of another person's rights.

26. Governing Law

These terms are governed by applicable United States law and, unless otherwise required, the laws of the State of Indiana, without regard to conflict-of-law principles.

Mandatory consumer protections in your location may still apply.

27. Changes to These Terms

Pulse Check may update these terms as the service, business, technology, or applicable requirements change.

The updated effective date will appear at the top of this page. Continued use of Pulse Check after updated terms become effective means you accept the revised terms.

28. Severability

If any part of these terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted.

29. Entire Agreement

These Terms of Service, the Privacy Policy, applicable subscription terms, and any written service agreement form the agreement between you and Pulse Check regarding use of the service.
